Elim implements physical, technical, and administrative security in compliance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), in order to maintain the privacy and security of your personal information. However, no such measure is ever 100% effective; therefore, we do not guarantee that your Personal Information will be secure from theft, loss, or unauthorized access or use, and we make no representation as to the reasonableness, efficacy, or appropriateness of the measures we use to safeguard such Personal Information. You agree that Elim is not liable for the unauthorized release of your information. If you choose to share your information with us via the internet or wireless connection (for example, via email messages), you do so at your own risk. Please exercise caution when using the Internet or any form of electronic communication.
What we collect:
Personal identifiable information that identifies you as an individual. Examples include your name, email address, mailing address, phone number, credit card, insurance information (if seeking reimbursement), other billing information, date of birth, sex, etc.
Healthcare provider information, including where they practice, NPI numbers, fax numbers, and the name, job title, and more.
Biological sample, such as saliva. Your sample is de-identified to protect your privacy.
How we use your information:
To provide the Service, e.g. set up account, send collection kits, billing, run sample, analyze results, send results, etc.
To communicate with you about the service, follow up if there is an issue with your information or sample, and provide information about your Results.
To help us improve the Service and develop new tests and services. Your sample may be de-identified and used to support validation studies and internal research and development.
To comply with applicable laws and regulations or requested by any judicial process or governmental agency, as well as comply with industry standards or our policies.
We disclose your personal identifiable information to your healthcare providers and those involved in your care.
As required by law, we may disclose your personal information to public health or legal authorities charged with preventing or controlling disease, injury, or disability. We will disclose your personal health information when required to do so by federal, state, or local law.
To bill and collect payment from you, we may disclose your information to your employer, health insurance, health system or clinic, or other responsible third parties. We may also engage third parties to assist us with these billing and collection efforts.
If your employer has provided or paid for (in whole or in part) your test, you acknowledge and agree that any de-identified Results and personal information may be aggregated, anonymized, and returned to your employer.
If your health system has provided or paid for (in whole or in part) the test, you acknowledge and agree that your Results and personal information may be provided to your health system. Elim disclaims liability for your health system’s use of information that it represents it is authorized to receive, store, and use.
We may disclose your information when we believe in good faith that doing so is appropriate or necessary, and to comply with applicable federal and state laws, rules, and regulations
